FragsList.com – General User Agreement

Welcome to FragsList.com, a website created by fragrance enthusiasts for fragrance enthusiasts. This General User Agreement (“Agreement”) governs your use of the FragsList.com platform (“Site”). By accessing or using the Site, you agree to comply with and be legally bound by the terms outlined below.
1. Eligibility
You must be at least 18 years old and legally able to enter into this Agreement to use FragsList.com.
2. Platform Use and User Conduct
FragsList.com is a peer-to-peer platform for listing, buying, and selling fragrance-related items. Users are fully responsible for all listings and transactions they create or engage in.
You agree to:
- Provide accurate and truthful information in all listings
- Post only items you legally own and are permitted to sell
- Clearly indicate the condition, quantity, and authenticity of all items
- Not list counterfeit, expired, or decanted testers in violation of law or brand terms
- Include a photo placard with your name, date, and city to verify item possession
- Refrain from spam, harassment, or any illegal or abusive activity on the platform
FragsList.com does not broker, endorse, or guarantee any transaction between users.
3. Disputes Between Users
FragsList.com is not a party to any transaction between buyers and sellers. In the event of a dispute, users must resolve the issue directly.
You agree that FragsList.com may share the contact information (such as email or phone number) of the buyer and seller involved in a transaction if necessary to facilitate resolution.
FragsList.com is not liable for any loss, damage, or dissatisfaction resulting from user interactions.
4. Privacy and Data Use
FragsList.com collects limited personal data to operate the platform, including:
- Name, email address, and general location
- Optional contact preferences
- User-submitted content (listings, comments, images)
We do not sell or share your personal data with outside third parties, except as described in Section 3 above.
While we take reasonable precautions to safeguard your information, you acknowledge that no online system is completely secure.
By using the platform, you consent to the collection and storage of your data in the United States.
5. Intellectual Property
You retain all ownership rights to content you submit (e.g., photos, descriptions). By uploading content, you grant FragsList.com a non-exclusive, royalty-free license to use, display, and promote that content within the platform.
You may not upload content that infringes on copyrights, trademarks, or intellectual property rights of others.
6. Site Availability and Modifications
We reserve the right to:
- Modify or discontinue any part of the Site without notice
- Remove or reject listings at our discretion
- Restrict or terminate access to any user who violates this Agreement
FragsList.com is not responsible for service interruptions, technical issues, or lost data.
7. Limitation of Liability
To the fullest extent permitted by law:
- FragsList.com and its administrators are not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the Site or participation in transactions.
- Our total liability shall not exceed $10 USD, regardless of the cause or claim.
8. Indemnification
You agree to indemnify and hold harmless FragsList.com and its administrators from any claims, losses, liabilities, costs, or expenses (including legal fees) arising from:
- Your use of the Site
- Any transaction you engage in
- Any violation of this Agreement
9. Arbitration and Legal Jurisdiction
All disputes shall be resolved exclusively by binding arbitration in the State of Missouri, under the rules of the American Arbitration Association.
You waive the right to participate in class actions or group arbitration.
10. Termination of Use
We reserve the right to suspend or terminate your access to FragsList.com at any time for any reason, including violations of this Agreement.

11. Agreement Acceptance
By using FragsList.com, you confirm that you have read, understood, and agreed to this General User Agreement. Continued use of the platform constitutes ongoing acceptance of any updated terms.
